President's Report Faro Park 1 & 2
August 2007


I have been President for Faro Park 1 & 2 for three year and have enjoyed it very much. It has been an honour for me to serve the community. I have been asked by many owners to put myself forward for a fourth year. I thank them for their support but for personal reasons I shall not be putting myself up for re-election for the coming year. This is my last report and I have decided to send it out early so as to give all owners who would like to volunteer for this position plenty of time to make their intention known in time for the AGM in October.

I would like to take this opportunity to thank all the people that have supported me over the years,

Pedro & Glen for volunteering at short notice last year for the position of Vice President.

Ian McLauchlin for setting up an excellent web site which I hope you will all be using.

Sam Magee and Stuart Jones for volunteering to form a working group to look into English T.V. and for managing this project.

Last but not least I must thank Jon Olsen for his help to me in difficult times and his loyalty to me and the community as our Administrator.

REPORT

Community Rules
At last year’s A.G.M it was decided that we should have community rules similar to the ones at Carlos Park and La Perla. As agreed the Board did this, incorporating what had been done before. There have been no objections by owners except the one about dogs around the pool which seems to have been totally ignored. I think at the AGM we need to have your opinion and a vote on the rules and any amendments you wish to make.

Garden Area
We have at last been able to make some progress with the garden area, removing the old dead grass from around the pool and planting palms and trees. I am sure you must all agree it is looking much better and I have had a lot of complements on how it looks. I was hoping to be able to complete all this work but it proved too expensive in one year so we have budgeted a further €5000 for this area in the coming year. Perhaps a small working committee can be set up to look into completing this work.

Maintenance
As was reported at last years AGM we were reviewing the Maintenance team. The board decided that as we had been getting more and more complaints about the existing team (Marcos and Anna), from a number of owners for not cleaning the pool, not cleaning the streets, not painting the lamp posts, not cleaning the refuse rooms etc, we decided we should go for quotes and therefore we reluctantly changed the maintenance company. The present company came highly recommended but there does not seem to have been any improvement. We have had constant problems on phase 2 with the lights. As maintenance is the area we spend most of our community money on it is constantly under review by the Administrator and the board.

The Pool
We drained the pool in January for the lights to be inspected but also found there appeared to be cracks in the floor of the pool. We took professional advice from three companies, one being the Club Lanzarote engineer, and got three different opinions. One company said the whole of the pool floor needed replacing at a cost of around €10000; the second said that the pool floor needed water-proofing and re-tiling which would also cost €10000. However, Club Lanzarote’s engineer said it only needed to be re-grouted where there appeared to be cracking. The board decided that, as we were getting a lot of complaints from owners about the length of time the pool had been empty, we should re-grout the cracks and refill the pool for this year and hope we had solved the problem. This will no doubt have to be looked into again.

Water Leak
We had two water leaks this year, one on phase 1 and one on phase 2. The leak on phase 2 was very difficult to find as no-one seemed to know where the main pipe was that fed phase 2. Both leaks have now been repaired.

English TV
This is now working satisfactorily after having teething problems but I think we must always bear in mind that we are picking up English programmes intended for England approximately 2000 miles away. It is quite easy to pick up Sky but not BBC and ITV free to air programmes. Any further questions on this subject should be addressed to the Administrator or the Board. All we want is a good reliable system.

Sewage Pumps
In May the maintenance company reported that the Sewage Pumps were worn out and after further investigation we were advised that the pumps were the wrong type and should be replaced. We were advised that to replace them with new pumps would cost €7000 or the old pumps could be repaired at a cost of €2000. In the Boards opinion we should have new pumps but that is for you to decide.

EGM
I cannot finish my last report without mentioning the call by certain individuals who asked me to call an Extraordinary General Meeting for the removal of the Board and replace them by themselves. At no time were we given a valid reason for this. We were given a list of 23 names of owners who wanted this meeting called and the Board gave this a lot of thought. We did consider resigning. But after agreeing to call the meeting we were told they had changed their minds. I was pleased to find out later that many owners had withdrawn their names from this list which actually made the action invalid. The president and the vice president are voted for at the A.G.M. and do not have to live permanently in Faro Park 1 and 2. They give their time and effort free for a twelve months term for the benefit of the community and any owner can volunteer for these two positions. The Administrator is also voted in at the AGM. For the benefit of the owners concerned the current Board consists of a President, Vice President and Administrator /secretary. Any changes to this have to be done by a unanimous vote at the AGM.

Community of owners of Faro Park Phases 1 and 2

Playa Blanca, 23rd August 2007.

Dear Owner,

Council Tax for 2007

The municipal taxes for properties, cars and refuse collection for the year 2007 are now due. The deadline for payment is 24th September 2007. The amounts are as follows: € 322.66, € 301.55, € 503.59, € 545.81 and € 301.55 for villa types A, B, C, D and E respectively. Owners paying by direct debit will get a 5 % discount on the amount. The taxes should be paid at the Oficina de Recaudación in Yaíza. If you are unable to go there yourself, we shall be happy to do it for you, at no charge. We can also set up future payments by direct debit if you so wish. The municipal rubbish collection tax is included in your community fee and will be paid for all owners by the community.

The cadastral values range from € 42.637,40 to € 77.173,69 and the exact value for your villa will appear on the receipt. It is this value that non resident owners should use when filing their Spanish tax return (form 210, 214 or 714, as the case may be). If you need assistance with your Spanish tax returns, we shall be happy to assist you with this.

AGM

The date for the AGM is 3rd October 2007 and the meeting will be held at the Natura Palace Hotel. I kindly ask that owners forward proposals and nominations for the meeting to a board member or to me to be received no later than 1st September. 

English TV

The service company recommends users to the system to make sure the Scart connections are pushed fully home as it does not take much movement to dislodge them, whichever type is used. It will save a call out if this is checked first. Users must also make sure that all other equipment such as DVDs , Videos, Satellite Receivers etc are switched to standby, and in the case of some old European TVs they must press the AV button on the TV remote.

17 jun 07           UPDATE ENGLISH TV

Dear owners,

         The installation of the 4 English channels is now progressing. The channels are: BBC1, BBC2, ITV1, and ITV2. It was initially attempted to distribute the signals using UHF, but owing to the already crowded frequencies, good pictures were only received on two channels. The others were compromised by interference from adjacent channels. In view of this and the fact that poor reception for the two channels is likely to deteriorate as and when less favourable weather conditions happen, it was decided it was preferable to distribute the signals using VHF to maintain the superior quality throughout the year.

         The only drawback that can be envisaged is if people have English makes of TVs that do not tune to the VHF bands and therefore will not display the 4 English programs. This is usually the case with old TVs. However, this problem can be corrected, by using a European video recorder as a modulator. Most English TVs that are younger than 5 years normally tune over the full frequency band anyway and would not be a problem. For owners with older TVs and who do not wish to upgrade their system, a full refund will be made.

                                                 When the installation proves satisfactory, but not before, the service company may distribute the signals to neighbouring developments. In that case, a compensation for our urbanization will be negotiated in respect of future maintenance fees. Adding users to the system will furthermore help ensuring commitment from the service company.

         The signals continue to be transmitted without encryption. The encryption boxes are manufactured in the UK and the service engineer is awaiting a shipment to permit encoding to take place. Encryption will take place once the dish and LNB has been sorted.

                                                 So far 49 owners have signed up for the satellite television. If you still have not signed up, but would like to do so at the initial price of € 135, then please contact me ASAP. The entry to the list of subscribers will close without further notice. Owners can sign up at a later date, but the price for a single installation will be € 200 or more, to be agreed with the service provider.

RECEPTION OF UK TELEVISION BROADCASTS

WORKING GROUP REPORT

12th APRIL 2007

The working group consists of Stuart Jones, Sam Magee, and

Tony Matthews.

REMIT OF THE WORKING GROUP

1 TO PURSUE AND ESTABLISH A DETERMINABLE DATE FOR THE RESUMPTION OF BROADCASTING SERVICES FROM COMTEC/ UKTVSL

2 TO INVESTIGATE ALTERNATIVE SUPPLIERS OF DISCRETE U.K. BROADCASTING SERVICES INCLUDING COSTING.

THE REMIT FOR SUPPLIERS.

To supply and maintain a suitable system for the reception of a discrete service to properties requiring BBC1, BB2 &, ITV. & CHANNEL4

COMTECH / UKTVSL

The group has worked tirelessly to re-establish and maintain a working relationship with both Comtech and their new owners UKTVSL. Despite numerous telephone calls and emails we have been unable to establish a definitive date for the resumption of a service to the community and we believe they are not technically able to meet our criteria for the long term service we are seeking.

We understand their current advertised costs for provision of UK television programmes are in the region of €750 set up fee plus €240 per year maintenance per individual client.

ALTERNATIVE SUPPLIERS

The group invited six potential suppliers and with the exception of one who declined to quote all prices received were within a very similar price range but only one supplier was able to meet the technical criteria for the provision of a discrete service.

DISCRETE SERVICE

Reception of English Television will be encrypted and only those subscribing to the service will be in a position to receive broadcasts.

SET UP COSTS

There are 37 owners who indicated a desire to receive the service at the E.G.M held in February.

We have been able to negotiate a discounted price for those owners who wish to take advantage of the service from the commencement date.

Those wishing to take advantage of the service as a part of the initial set up will be charged a one off fee of €135.00 payable in advance. This figure includes the cost of the encryption box.

Please advise the Administrator Jon Olsen of your preferred method of payment.

Please note all payments should be made to the Administrator by 23rd April 2007.

Any owner who to date has not indicated a desire to subscribe to the service at the commencement but wishes to do so should advise the Administrator including payment in full by 23rd April 2007 to take advantage of the discounted price.

Those wishing to subscribe after the commencement date of the 23rd April will incur a cost of €200.00 which includes a call out fee payable in advance.

MAINTENANCE COSTS

All equipment supplied will be guaranteed for a period of twelve months from the date of supply including the encryption boxes.

An annual fee will be agreed between the community and the supplier to cover non guaranteed events such as realignment of the dish etc.

Comunidad de Propietarios Faro Park fase 1 & 2

Playa Blanca – Yaiza - Lanzarote, 31st March 2007.

Dear Owners,

 

Herewith are the Minutes of the EGM that was held on 27th February 2007. The minutes

were posted on our website on 17th March (see above link). In the minutes it appears that when the vote was taken, 4 votes were not recorded. We have received an objection to this and a request that the votes of houses number 65, 66 and 73 should be recorded as "NO".

This will be dealt with under "Matters Arising from the EGM" at the next AGM and

included in the corresponding minutes.

The result of the meeting was that the proposal for the English Television got 37 votes

in favour, which is sufficient to have the installation; however, only those voting in

favour will be able to receive this service and are obliged to participate in the cost. The

TV work group, consisting of Sam Magee, Stuart Jones and I, are now in contact with

various suppliers and we expect to write to owners again on this matter in the next

couple of weeks.

 

A request received by the Board for calling an EGM to deal with matters related to the

Board and maintenance issues has been withdrawn. We thus anticipate that the next

General Meeting of Owners will take place as scheduled on Wednesday, 3rd October

2007.

 

We take this opportunity to recommend that you frequently check the water meter of

your villa. If there is a leak inside your property, the value of the water would not be

covered by your home insurance. The Community pays for the water that is delivered

to the main water tank and must thus charge the individual owner for all water

registered by the individual house meter, even if there is a leak inside the property.

 

The street lights on phase 2 have been faulty for some time now. The problem could not

be solved satisfactorily due to the fact that we did not have the necessary spare parts.

However, Club Lanzarote has now kindly loaned us the necessary material and the work

is now being carried out and we expect the lights to be back to normal very shortly.

 

The swimming pool was closed in January to deal with routine maintenance matters;

repairs to the underwater lights, repairs to the grouting etc. However, when the pool

was emptied and a thorough inspection could be carried out, the company involved

raised serious concerns regarding the adhesion of the tiles to the base. On several areas

the tiles have become detached from the bottom. This could be a serious matter that

must be dealt with within the next year or so. We had 3 different companies inspecting

the pool. The conclusion and recommendation of all of them was to carry out necessary

repairs to the grouting and tiling for the short term. The company which finally did the

work, Crystal Clear Solutions (Mr. Stephen Scott), said that the pool will probably be OK

for the remainder of the year but that a complete overhaul of the tiling should be made

no later than next winter.

 

The water leak on phase 2 has still not been located. This is due to lack of proper plans

of where the water pipes go. We are now carrying out the search with listening devices

so as to locate the area where the leak is.

 

We remind owners that dogs are not allowed near the swimming pool. Furthermore,

guests have been observed using the newly prepared picón areas for sunbathing.

Children have been observed throwing picón onto the tiles surrounding the swimming

pool. We kindly ask that guests are made aware that the picón areas are not to be used

for sunbathing and that parents ensure that children do not throw picón into the

swimming pool or onto the tiled area.

 

Finally, we advise you that these forthcoming dates are Bank Holidays here; April 6th

Good Friday; 1st May Labour Day; 15th May San Isidro, 30th May Día de Canarias and

16th July Nuestra Señora del Carmen.

Playa Blanca, 30th January 2007

Dear Owners,

Television

I am constantly being asked what has happened to the English TV at Faro Park. It

has now become clear that the present system is unreliable and at the moment

has been off from the 26th September. We have had many explanations from John

Ambler of Comtech Canaries SL; that he was moving the dish, upgrading the

system, needing a new licence from Madrid and “It will be on next week”, which to

date has not happened. A solution to this situation has to be found and with this in

mind I have set up a small working group to look into the best way forward. The

group is currently made up of Mr. Sam Magee Villa 58, Mr. Stuart Jones Villa 102

and I. We believe the solution is to have a system under the community control. It

will have the same programmes we have been receiving; BBC1, BBC2, ITV1, and

Channel 4. As before, it will be sent via the community system and maintained by

the community. The dish will cost approximately € 4.000 fitted and running, €40

for each villa, - a small price to pay, as this will add value to all our properties. We

successfully installed the Digital Terrestrial Television last year on request of the

Spanish owners and we sincerely hope that all owners will support the project as a

wide offer of television channels will, no doubt, increase the enjoyment and worth

of all properties.

Road safety.

The maximum speed limit within Faro Park is 20 km/h. I kindly ask that this is

observed at all times. With regards to the safety in Calle Irlanda, the dual

carriageway outside the urbanization, we would like to join forces with the other

phases of Faro Park and install sleeping policemen on the pedestrian crossings.

The proposal is to divide the costs according to number of units in each

urbanization. I expect the expense to be about € 45 per villa.

EGM

To decide on the two issues mentioned above, I am calling an Extraordinary

General Meeting to be held on Tuesday, 27th February 2007. The summons to the

meeting is enclosed herewith. No other matters will be discussed at the Meeting

and if you are unable to attend the meeting, you can instruct your proxy in writing

using the enclosed form. We need a majority vote to carry these projects forward

and it is very important that you return your Proxy vote to me or anyone who is

going to be at the meeting. We should be able to get the television system up and

working in about a month of getting your agreement. If you need any further

information please contact me or Jon Olsen.

Outstanding amounts

At the last AGM I was instructed to take legal action against community debtors

for unpaid fees and water bills. I am happy to report that many owners have now

settled their outstanding bills and in particular the so-called back water invoice. At

present it seems that legal action will be necessary only in a few cases. I am also

happy to report that more owners are setting up direct debits through the

administrator for payment of fees and water bills and I encourage all others to do

so. This greatly simplifies the work for the administrator and his staff.

Website

Dr. Ian McLauchlin of villa nº 95 has kindly set up a website for the owners'

association.

The site is really good and owners can contribute to make it better, if you wish,

with photos, comments and other ideas. At present you will find Minutes of the

AGM, statutes etc and contact information. I would like to thank Dr McLauchlin for

his first rate contribution and ongoing efforts. The website is found at:

Water

Club Lanzarote, SA advises that the central sewage plant is now in operation and

that a surcharge of € 0.34 will be applied per m3 for sewage from 1/10/2006; a

charge which is identical to that of Inalsa, the public water company. The charge

will appear on your next water bill. On the subject of water, I recommend owners

to monitor their water meter regularly so as to detect any leakage inside your

property. The individual owners are responsible for all water consumption

registered by the meter at the entrance to the properties. If a leak were to occur

inside your property, the water invoice could be very high and this is not covered

by the community or by your insurance company.

Swimming pool and adjacent areas

The swimming pool is undergoing repairs and will remain closed for about three

more weeks. We are carrying out works to prevent leaks and improving the

underwater lights. Also the tiled area around the pool will have necessary regrouting

done. The grass in the immediate areas on the sides of the swimming

pool has been removed and replaced with picón. New palm trees have been

planted and a screen of fir trees has been placed to the western wall. Owners are

kindly asked not to add any plants to the common areas. If you have cuttings or

spare plants to donate, please contact me or the administrator. To ensure

undisturbed access for emergency vehicles to the swimming pool area, I kindly ask

owners not to park any vehicles in the four access ways, i.e. the two access ways

on both sides of villas 43 and 44 and the two access ways on both sides of villas

68, 69 and 70.

Emergency telephone number

The emergency number for police, fire and ambulance is 112. If you have the

standard telephone, the “Domo”, you need only press the red button to make the

emergency call.

Rubbish collection

Please bear in mind that the arrangement for our rubbish collection includes only

household rubbish. You must not leave other types of rubbish, e.g. old furniture,

construction debris, garden refuse, etc, in the rubbish rooms (or in any other place

for that matter). Please make sure that any person working for you is made aware

of this. Make sure that the existence and location of the relevant rubbish rooms is

brought to the attention of any guests using your house.

Local elections

Non-Spanish European Union citizens residing in Spain are entitled to vote at the

municipal elections to be held on 27 May 2007. To be an elector and thus be able

to vote, it is an essential requirement to be on the polling lists, and one has to be

registered in the electoral census, for which purpose it is necessary to be

registered in the municipal register (Padrón municipal), be of legal age on voting

day and have declared the intention to vote at the municipal elections. All persons

living in Spain should register with the municipal register at the municipality where

he/she lives.

Those persons not yet registered should register as soon as possible in the

municipality of their habitual place of residence. Should you have any doubts

regarding your municipal registration, please approach your Town Hall.

Council Tax

I recommend all owners to place the Yaiza Council Property Tax (IBI, or Impuesto

de Bienes Inmuebles) on direct debit. Those owners on the direct debit scheme will

have a 5% discount on the tax bill. Jon Olsen shall be happy to arrange this for

you at no charge.
