Message from the Board

Throughout the summer period problems have arisen with non residents using our swimming pool facilities. This caused much concern to owners on our complex. People were challenged and informed that the pool was private and only for use by owners on our phases. Board members and an owner on occasions had serious threats made to them by the trespassers. On one occasion the Police were called by the President who sadly was informed they would not attend and to make a report the next day at the Police station. If we do not have Police responding to serious incidents, the Board will no longer challenge trespassers without adequate numbers of owners being around.

New notices are being placed at each entrance of the pool area indicating the community does not accept any liability for injuries or accidents to non residents and families using the facilities. Pool rules are also being posted together with the emergency telephone number in the event medical assistance is required and also indicating the complex does not have a Life Guard. It would be appreciated if owners could make their guests aware of this information. Furthermore, owners who constantly have guests in their villas should have adequate liability cover insurance in case of any accidents occurring within their area as well as the complex itself. The Community does not accept liability as this is the villa owner’s responsibility.

You will recall at the recent AGM that a working party was formed to investigate the installation of a pool safety fence. This is the legal requirement of Spanish law for swimming pools within a residential complex and this was explained in detail by Rudi Herz in his presentation. The working party is making good progress, but meanwhile your Board would welcome your participation in a survey that has been made available on our website www.faropark1and2.info to ascertain your opinion on this matter. We would ask all owners to simply click on this link to register your preference. This will be confidential and the sender cannot be identified. We thank Ian McLauchlin, Villa No. 95, for his work in setting up this survey on our website.

 

At the AGM an owner asked if a solution could be found for disturbance caused by noise in the Community. The Board now have standard letters available to be sent to occupants of the villa concerned advising them of the Community rules and of what action could be taken against them if they continue with the disturbance. Copies of these can be viewed at the Administrator’s office.

The finances are, as predicted, going in the right direction with an increased surplus (over the corresponding quarter last year) at the end of the first quarter. The water invoicing will shortly be the responsibility of Club Lanzarote and all owners should be aware that their COMMUNITY FEES AND WATER ACCOUNTS must be up to date as the Administrator has to issue a certificate for each property. Failure to supply the certificate to Club Lanzarote will result in the loss of domestic water supply and a re-connection charge paid to Club Lanzarote.

Legal action is ongoing with debtors who owe money to the Community. This is a slow procedure but action has been taken to recoup this money. Pedro Soriano has offered the Community legal assistance free of charge for his services. We thank Pedro for this kind gesture.

Work has now commenced on some minor improvements in the Green Area with further work to follow when funds become available.

Again we report blocked drains caused by objects being flushed down the toilets. This seems to occur shortly after half term weeks and we ask owners again to inform their guests this practice is not allowed.

The correct colour paint for our villas can be purchased from the show house, situated at the roundabout beyond the shops. The prices are -

55 euros Interior and 45 euros Exterior per 15 litre can.

Building Works

We kindly remind owners to submit in writing any plans to changes to their property and to remember that permission from the Board is required before ANY type of building work is commenced. Please bear in mind that only visually similar materials and colours shall be used and that the planned changes must adopt the original characteristics and design of the existing houses. Please inform the Administrator of the name and telephone number of the person in charge of the building works.

Rubbish Collection Taxes 

The Town Hall in Yaiza has recently sent out notifications for payment of the municipal refuse collection tax. This payment is included in your community fees and is therefore paid by the community as a whole. Please disregard this notification.

Commercial Letting

Owners are reminded that under the Rules of the Community, commercial letting is not permitted.  If you allow friends or family to make use of your villa, please inform them that Faro Park 1&2 is a private, residential area. Make sure that they are aware of our rules and regulations. If you need extra sets of these, please contact the Administrator.

Rubbish

We kindly ask that all non-domestic rubbish (old refrigerators, water heaters, etc) must be taken to the Municipal 

Collection Point on the road to Femes.

Change of Bank Account

The community bank account has moved from Banca March to La Caja Insular de Ahorros de Canarias. The bank account number is 2052 8089 63 4910010107. The change does not affect owners paying by direct debit.

Office Move – Administrator

Jon Olsen is moving office and the new ad- dress will be Calle Lanzarote nº 11, premises 5, 35580 Playa Blanca, date to be notified. Contact numbers will remain the same. This is the commercial centre La Mulata at the end of the cul-de-sac past the Natura Palace Hotel.

How to proceed for Medical Attention

If you are a non-resident owner, you must present the new European Health Insurance Card (this replaces the old E-111 form) issued by the UK post office and your passport at the health station if you are in need of medical attention. As a resident you present your "Certificado de Ciudadano de la Unión", your passport and your Spanish Health card. The health station is located as you pass the petrol station, next to the La Bocaína restaurant and is open from 8 am to 8 pm. The telephone number is Tel: 928 517 542.

 

Taxes in Spain

Getting a Certificate of Residence from the Town Hall, being the bearer of the old residency card or having the new green "Certificado de Registro de Ciuda- dano de la Unión" does not mean that your fiscal residency has changed or that you are exempt from the obligation to file a tax return in Spain. All foreign property owners in Spain must file a tax return. There are two options;

a) As a fiscal resident of Spain, you must file form 100 by 30th June or

b) As a fiscal non-resident you should file form 210 by 31st December.

Many non-resident property owners in Spain are under the misconception that they can forget about submitting their annual tax forms! It would be nice, but it is not the case. However, the good news is that from the tax year 2008 (filing deadline 31.12.2009) the taxes payable will be less than in previous years. Up until the end of 2007 non-residents with property in Spain were liable to pay a "wealth tax" (Patrimonio), which was calculated on the purchase value of their property, and an "income tax" (Renta), which was calculated on the actual in- come or on the cadastre value (public tax value).

From January 1st 2008 the wealth tax has been abolished, but the "Declaración de la Renta" or "Non-Resident's annual tax return" must still be made and paid! The income tax is 24 per cent of the "Deemed Rental Income". The calculation is as follows:

Multiply the cadastre value by 1.1 % per cent. 

Take this value and multiply by 24 per cent - that is how much deemed rental income tax you pay. The "Deemed Rental Income", which used to be included on the 214 form, is now declared on form 210.

If the property is rented out, the gross income received, excluding I.G.I.C. is taxable at 24 %. If the property is only rented out for part of the year, the earnings are calculated as above for the rented period. For the part of the year that it lies empty, the calculation is made as for "Deemed Rental In come".
